                   AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS
                   AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS
                   TO REZONE A TRACT OF LAND LOCATED AT 1101 WEST
                   40TH STREET, BEING OFF THE NORTHWEST LINE OF
                   WEST 40TH STREET NORTHEAST OF TENNESSEE AVENUE,
                   FROM R-3 RESIDENTIAL ZONE AND M-1 MANUFACTURING
                   ZONE TO C-2 CONVENIENCE COMMERCIAL ZONE,
                   SUBJECT TO CERTAIN CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as
         amended, known as the Zoning Ordinance, be and the same is 
hereby
         amended so as to rezone:
               
                A tract of land located at 1101 West 40th Street,
                being off the northwest line of West 40th Street
                northeast of Tennessee Avenue.  Tract 2A, Fourth
                Revised Plan, Resubdivision of Tract 1, Winn-Dixie
                Addition to St. Elmo, as shown by plat of record in
                plat book 58, page 116, ROHC; being part of the
                properties described in deed book 956, page 210,
                ROHC, deed book 1600, page 632, ROHC, deed book
                3709, page 573, ROHC, and deed book 4483, page 59,
                ROHC.  Tax Map No. 155O-M-11 (part) and 12.1
                (part).
               
               
         from R-3 Residential Zone and M-1 Manufacturing Zone to C-2
         Convenience Commercial Zone.
        
              SECTION 2.  BE IT FURTHER ORDAINED, That this rezoning 
shall
         be subject to the following conditions:
        
              1.   Landscape conditions (attached);
        
              2.   General Policy Guidelines (attached) of the Southside 

              	   Area Plan;
        
              3.   All existing easements are retained.
        
        
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage, as
         provided by law.
